Barry McTaggart worked in the financial services industry both for the Financial Ombudsman Service as an investigator and as an assistant fund manager, responsible for equity valuation for a 鈧1bn multi-asset investment portfolio.

This follows the news from April this year that the seven-office, national chambers had taken on three other barristers for twelve-month pupillages namely Liam O'Shaughnessy and Eaindra Cho (both focusing on employment and discrimination) and Simon Haywood (civil litigation, focusing on commercial, property and costs). All three have successfully completed their first six and are now on their feet and available to take instructions in their own right, both to appear in court and on advisory matters.

Former Fleet Air Arm Officer James Hume (call: 2023) joins 海角破解版's London office following 11 years in the Royal Navy where he will continue to grow his practice within the Commercial, Property and Construction Teams. Throughout his pupillage, James gained significant experience in High Court and County Court matters and specialises in commercial litigation, arbitration, property and construction law disputes. He has represented clients in court for both complex and more routine cases involving interim injunctions, breach of contract claims, insolvency petitions, Defective Premises Act cases, construction contract disputes, possession claims, easement disputes, adverse possession and adjudication enforcement. James is also in demand for advising clients across his three areas of practice, with some of his more notable pieces of work involving piercing the corporate veil, fraudulent misrepresentation, the Third Parties (Rights against Insurers) Act 2010, NHBC Guarantee disputes, private nuisance, property auction sales and general breach of contract claims.

Emily Hayward (Call: 2022) joined 海角破解版 as a pupil from Slaughter and May's Disputes and Investigations Team and will continue to grow her busy commercial and insolvency practice within 海角破解版's Commercial and Chancery Teams. Throughout pupillage, Emily has been instructed on matters before courts and tribunals at all levels as well as an ICC arbitration. With experience of representing and advising clients across myriad commercial disputes, including advising on a multi-million-pound claim involving breach of fiduciary duties, acting for publicly listed companies in insolvency proceedings and contract disputes with multi-jurisdictional elements. Further building on her experience whilst at S&M where Emily worked on several high-profile cases across competition and commercial law, including the Vodafone CPO, CMA/Motorola indexation dispute, FDIC Libor and the 拢5 billion BHP civil lawsuit. Emily also has been involved with a complex counterterrorism matter before the Investigatory Powers Tribunal, a Judicial Review of the Agriculture Act 2020 and advised on an ECtHR matter regarding breaches of Article 3 of the ECHR.

Former human rights paralegal with law firm Hickman & Rose, Toria Holland (call: 2023) is joining 海角破解版's Winchester office and has already established a busy family practice, taking instructions in all areas of family law. In her first six, she spent 5 weeks assisting a team of three barristers who were led by a silk on a fact-finding hearing in the High Court representing a father which resulted in findings of parental alienation by the mother. In her second six, Toria has represented clients at all stages of proceedings in private children, including multiday final hearings. She has a wealth of experience in family law injunctions and high success rates. Toria is regularly instructed in care proceedings, having represented family members and local authorities in a range of hearings, from initial urgent hearings through to final hearings. Toria is also building a busy practice in matrimonial finance, having been instructed on FDRs and final hearings.

The High Court of St Kitts & Nevis is determining the constitutionality of the death penalty and has granted permission for the intervention to be filed by the (CLA) and the (IBAHRI). A hearing on the matter is currently scheduled for November.

Alongside Emily, Philip Rule KC was assisted by Alexander Heylin and Daniel Henderson (No. 5 Chambers) and Abdul Rashid Ismail (University of Oxford/ Malaysian Bar). The day welcomed over 100 attendees and featured a distinguished line-up of speakers, including , , , and among others. These leaders shared their insights on a wide range of issues affecting women at the Bar, including bullying and harassment, the gender pay gap and juggling motherhood with practice, providing invaluable perspectives and fostering an environment of learning and growth.

Attendees also had the opportunity to explore resources from our sponsors such as the personal development coach from ; wealth managers, from and Michelle Jerome and Andrew Christodoulou from , who offered essential financial planning and mortgage guidance for busy barristers. , a former president of and current member of the University's Council, is seen here presenting the award to Oliver (credit: RedPix Photography). The award highlighted Oliver's many contributions to the University's Law School and his promotion of social mobility and access for students to a career at the Bar and in the wider legal profession.

Practising across the UK - particularly on the - Oliver is a regular fixture at Leicester County Court, both as counsel and as a Deputy District Judge. As an Honorary Associate Professor at , Oliver previously taught Public, Land, and Contract Law from 2011 to 2021, becoming a popular Teaching Fellow at Leicester.

A mentor through and the Future Bar Programme at , Oliver now also sits on Advisory Board, and is leading a new marshalling scheme for Leicester students to shadow judges at the Leicester County & Family Court. Oliver delivers the annual 鈥淥liver鈥檚 College of Knowledge: Mooting 101鈥 lecture at both Leicester and Nottingham universities, offers employability workshops across the Midlands, and trains advocates for Lincoln鈥檚 Inn and the Midland Circuit.

Oliver co-founded the Jeffers-Nunn Award at Leicester Law School and was named 2023 Barrister of the Year by the Leicestershire Law Society. That same year, Oliver was nominated for the Nottinghamshire Law Society Equality & Diversity Champion Award for his tireless work expanding access to the Bar.

This is the first such placement run by 海角破解版 (3 Paper Buildings) and may well be one of the very first such initiatives run by a barristers chambers in the UK.

Jodie Mittell KC, who co-heads 海角破解版's 30-strong team of Crime and Regulatory Crime barristers said: "海角破解版 is delighted with the success of this placement. We thoroughly enjoyed having Sophie with us and she proved to be an excellent placement student. We are very hopeful that there will be other student placement schemes we can organise with universities in the coming years."

Sophie said: "I spent six months gaining fantastic experience including shadowing in the Court of Appeal, attending prison cells and drafting legal documents and advice. Members of chambers have been wonderful, and very generous giving me their time to further understand what life at the bar is like. Former first-class law graduate Zahra Tierney (call: 2022) will continue her busy practice with a particular focus on property law (particularly residential landlord and tenant issues), commercial law and general civil litigation from 海角破解版's Oxford office. A former paralegal, Zahra worked for two London-based law firms and specialised in property and commercial litigation as well as handling cases involving property disrepair, local authorities' housing decisions, multi-track fatal personal injury claims and other high-value civil law claims. She showed her passion for advocacy from a young age, advocating in Parliament for the Arbitration and Mediation Services (Equality) Bill as a teenager and received scholarships and awards in her studies.

Former Irwin Mitchell in-house advocate Jeremy Warner (call: 2022) is joining 海角破解版's London office. Jeremy has developed a busy and varied practice in personal injury, clinical negligence, and inquests. His time in-house and during pupillage provided substantial exposure to complex and multi-track litigation, including cases involving fatal accidents, birth-related injuries, and noise-induced hearing loss. He has appeared in a broad range of hearings including fast track trials, CCMCs, and inquests. He is regularly instructed to advise on liability, quantum, and procedural strategy. An Inner Temple scholar, Jeremy was shortlisted for a national law reform essay competition for his work on the Bereavement Award under the Fatal Accidents Act 1976. He is also building a Court of Protection practice, with a focus on property and affairs disputes. He has also recently been appointed to the Attorney General鈥檚 Junior scheme.

Cheryl and Jack analyse the principles concerning costs in probate proceedings and explore how important the rulings made in Leonard v Leonard could be for probate cases with a reliance on common law exceptions, especially those that have potential to demonstrate unjust consequences of Part 36.

Over 75,000 people this year participated or watched Birmingham Pride with the parade starting at Centenary Square before making its way through the City to the LGBTQ+ Village, off Bromsgrove Street.

The charity was started in Dublin in 2009 and raises vital funds for mental health, suicide bereavement, and awareness charities. This year's ambassadors include Caroline McKenna (teacher and founder of Sunrise Social), Tom O鈥橳oole (Ulster and Ireland rugby player), Aaron Kernan (Former GAA player), and Toni Leigh Finnegan (Cliftonville and NI women鈥檚 footballer).

Anthony Miller first entered media circles as a teen model, which led to him working in various areas of media and entertainment. His work at the forefront of Civil Partnerships being introduced in the UK placed him in front of the camera as an expert and TV presenter. He enjoyed many years in broadcast and print media before qualifying as a barrister. He continues to interview celebrities for his video series "Anthony Meets".

All the ambassadors of Darkness into Light are involved in the media and lend their platforms to the campaign. Anthony has been promoting the charity to his followers across to encourage people to participate and sign up to raise funds. He is also bringing attention to the discussions around mental health and awareness of the local charities in Northern Ireland, where he was raised.

Anthony, who was diagnosed with ADHD as a student, spoke positively of his experiences with mental health in a recent Irish News feature (link) about his appointment as an ambassador for the charity and his own personal journey to becoming a barrister at one of the UK's largest and best-known barristers chambers, as well as his battle with self-doubt and other mental health issues. He has often shared this in the press and in his TEDx Stormont talk #goodenoughforme.

Thousands of people walk, swim, bike, and hike for Darkness into Light (DiL) each year, and the annual sunrise event began in Northern Ireland on May 11. Organised by Pieta and supported by Electric Ireland, the event supports the life-saving work of 14 partner charities providing suicide prevention and bereavement services across Ulster. More than 鈧3.5m was raised earlier this month after 91,000 people across Ireland signed up to the 230 official walks taking place simultaneously, beginning at dawn and ending at sunrise, symbolising the journey from despair to hope. The event is also now held internationally, with events from Seoul to Spain and New Zealand to the Netherlands.

Formerly Jane Hayward, she was a solicitor for 17 years and accredited as a member of the Law Society鈥檚 Children Panel. Now a barrister, Jane represents parents, grandparents and other family members, children鈥檚 Guardians, Gillick competent children, vulnerable persons including through the Official Solicitor, as well as local authorities.

Maisie Carter (call:2022) joined 海角破解版 after completing a 12-month pupillage at a specialist family law chambers in the North West of England and has already begun to establish a busy family practice, acting in public and private law children matters and injunctive proceedings. She will be supported by 海角破解版's new criminal law and regulatory pupils Kate Davies and Jack Felvus. With a strong following and active client base for a barrister of her level of call, Holly has a busy practice both prosecuting and defending in the Magistrates鈥 Court and Crown Court across the Western Circuit.

Holly has acted in multi-handed criminal trials. She routinely appears in sentencing hearings and is frequently instructed in cases involving a range of offences such as; burglary, intentional strangulation, ABH, racially aggravated offences, assaults on emergency workers and weapons and drugs offences. Holly has an exceptional record in defending motoring offences, fraud, sexual offences and assaults against the person. Holly recently defended a sentence where her client, who had pleaded guilty to three counts of PWITS (class A and B), was given a suspended sentence with no requirements. Holly also secured an acquittal for one client who faced three charges of sexual assault on two 15-year-old-girls. Another recent case involved a client who had been convicted of grooming multiple children online. Despite the custody threshold being crossed, Holly persuaded the court that a community order was appropriate.

Before converting to law, Holly worked as a management consultant with regulated infrastructure businesses. After qualifying, Holly worked as a Screening Case Officer for the Nursing and Midwifery Council (NMC) which gave her insight into regulation and professional disciplinary issues and she has started to develop her practice in these areas of law.

During her legal studies, Holly volunteered as an Appropriate Adult in police interviews, which enhanced her ability to communicate with vulnerable adults and youths. She also volunteered with Vocalise, teaching debating to prisoners in HMP Pentonville, and as an advocate with the Community Empowerment Network which involved representing children at risk of being permanently excluded from school.

Former in-house lawyer and domestic violence and disability campaigner Liz Adams (call:2021) will be based from 海角破解版's Birmingham office and will be focusing on family disputes (including public/private children law and finance) and education law.

Former law firm PA Emma Greening (call:2022) will be focusing on employment and discrimination disputes and will be based from 海角破解版's Oxford office.

Former academic Dr Angel Matoke-Njagi (call:2022) is joining 海角破解版鈥檚 Bournemouth office and will be focusing on family law, specifically private and public law disputes concerning children and financial remedies.

Michelle Marnham and Jeremy Warner review important clinical negligence case of Malik v St George's University Hospital NHS Foundation Trust /michelle-marnham-and-jeremy-warner-review-important-clinical-negligence-case-of-malik-v-st-georges-university-hospital-nhs-foundation-trust/ Wed, 12 Jul 2023 13:53:52 +0000 /?p=25666 海角破解版's Head of Personal Injury and Clinical Negligence Groups, Michelle Marnham聽(pictured here), together with future 海角破解版 pupil barrister Jeremy Warner (who joins in April 2024) have reviewed the case of Sidra Bilal, Hassaan Aziz Malik (Administrators on behalf of the estate of Mukhtar Malik, deceased) v St George's University Hospital NHS Foundation Trust, [2023] EWCA Civ 605. This Court of Appeal decision offers an interesting insight into the post-Montgomery landscape. It provides further clarification on informed consent as well as reminding practitioners of the importance of tightly crafted pleadings in clinical negligence claims.

The claim was brought by the personal representatives of a deceased claimant, Mr Malik, aged 48 at the date of trial, who had a history of spinal problems commencing in 2012 consisting of pain, leg weakness and altered sensation. Following two surgeries by Mr Minhas, Mr Malik鈥檚 condition significantly worse. He suffered paraparesis and was to be wheelchair dependent for the remainder of his life. Mr Malik died on 14 July 2021 from causes secondary to his spinal condition.

The Court of Appeal found that the original trial judge HHJ Blair KC, sitting as a Deputy High Court Judge, was correct to apply Bolam before then considering whether Mr Malik had been made aware of the material risks involved in the recommended treatment and reasonable alternatives. In other words, as Mr Minhas came to the (non-negligent) conclusion that no other treatment was available, it was therefore not necessary to advise on additional treatments he did not consider necessary or prudent. Davies LJ also concluded that Mr Malik did not provide evidence that he would have elected to defer or reject surgery if told something different about the prospects of success due to the duration of the pain. As Mr Malik鈥檚 argument was not borne out in any evidence, this point was additionally dismissed.

The authors consider that the two key takeaway points from the case are firstly, that allegations of negligence must be pleaded with precision and that secondly, and as confirmed by the Supreme Court鈥檚 decision in (handed down today 12/07/2023), whether treatment is a reasonable alternative is to be determined by application of the professional practice test (i.e. Bolam, as qualified by Bolitho). Therefore, a doctor is not obliged to tell a patient about treatments that the doctor does not consider reasonable (applying the professional practice test), even where the doctor is aware of an alternative body of opinion which considers the treatment to be reasonable. Thus the clinicians鈥 conduct should only be construed through the Montgomery lens if other forms of treatment are 鈥榬easonable alternatives.鈥

Lucy Bill is doing a specialist pupillage in personal injury and clinical negligence, whilst Rosa Thomas is combining education and employment in her pupillage. Both are pictured here, left and right respectively.

Lucy is a First Class LLB graduate from Queen's University Belfast with an American Business Administration Certificate from Mary Baldwin University and is also a BPP Career Commitment Scholarship holder, a Washington Ireland Program Alumna and an Oxford University Press Moot Grand Finalist and Runner Up. She worked as a consumer law student adviser with the Hackney Law Centre, a housing law drop-in clinic advisor and a benefits assistant whilst studying. More recently she has been working as a paralegal with F-LEX and been a legal intern with law firms such as Pinsent Masons, Allen & Overy and A&L Goodbody.

Rosa is a history and politics graduate from Oxford University and was awarded several scholarships and prizes as well as being a World Schools' Debating Champion. She won the HRLA Judicial Review Moot (entered by over 90 teams) and was a European Universities Debating Championship Finalist (entered by 194 teams) as well as an International Refugee and Migration Law Moot Finalist. A volunteer caseworker with Amicus, the City Environmental Law Policy Clinic and the Environmental Law Foundation, Rosa also worked with Schools Exclusion Project and represented parents at Governors鈥 Disciplinary Committees and Independent Review Panels to seek the reinstatement of excluded students.

This follows the news from last October about 海角破解版's recruitment of four new pupil barristers. The full-service chambers now take on six pupil barristers every year for its 12-month pupillages - and boast a current cohort of ten pupils.

The National Pupillage Fair, which took place at The Honourable Society of Lincoln鈥檚 Inn last month, is one of the UK鈥檚 largest pupillage fairs attended by law students from across the country. As part of the Fair, a talks programme is offered, giving students an insight into all aspects of life at the Bar.
