The prosecution case was that, at the instigation of her daughter, JA planned to kill the deceased by luring him to a house where he was stabbed by her daughter鈥檚 boyfriend.

Following an 11-week trial before Martin Spencer J at Salisbury Crown Court, the jury unanimously acquitted JA of planned murder, convicting her of the lesser offence of manslaughter.

It was accepted that serious injuries had been caused by her client but the issue for trial was intent.

After careful questioning of both the complainant and the defendant Rebecca鈥檚 client was acquitted. This vulnerable client would have faced a period of imprisonment of around 5 years if found guilty.

海角破解版 Barrister Successful in Appeal on Availability of Default Judgment After Late Filed Defences /3pb-barrister-successful-in-appeal-on-availability-of-default-judgment-after-late-filed-defences/ Fri, 08 May 2026 09:38:03 +0000 /?p=40973 Oliver Nunn has successfully represented the Respondent in an appeal concerning the Court鈥檚 jurisdiction to enter default judgment where a Defence has been filed out of time but an extension of time has been refused.

The appeal arose out of proceedings brought by a finance provider to the private medical and dentistry sector. At first instance, the Defendant鈥檚 application for an extension of time to serve a Defence was dismissed and judgment was entered for approximately 拢90,000, together with costs. The Court also made findings of abuse of process, concluding that the Defendant鈥檚 CPR Part 18 Request was not a genuine request for clarification but an attempt to delay the proceedings.

On appeal, the Defendant contended that, because a Defence had in fact been filed prior to judgment being entered (albeit late), the Court lacked jurisdiction to enter default judgment under CPR 12.3(1). The appeal raised a novel procedural issue as to whether a Defence filed out of time, but in circumstances where the Court has refused an extension of time, is capable of preventing the entry of judgment.

Appearing for the Respondent at first instance and on appeal, Oliver advanced a number of technical arguments, including that the refusal of an extension of time meant the Defence was not filed in accordance with the CPR and therefore could not amount to a valid statement of case for the purposes of CPR Part 12. Alternatively, it was submitted that the Court had determined a preliminary issue as to whether the Defendant could rely on the late Defence, permitting judgment to be entered under CPR 3.1(2)(m). Further reliance was placed on CPR 3.10, on the basis that the late filing constituted a failure to comply with the rules and was a step which had been invalidated by the Court鈥檚 refusal to grant relief.

The Court considered a number of authorities in this area, including Ahmad v Ouajjou聽[2022] EWHC 3087 (Comm), Smith v Berrymans Lace Mawer聽[2019] EWHC 1904 (QB) and Galliani v Sartori聽[2023] EWHC 3306 (Comm).

HHJ Hedley, the Designated Civil Judge for Leicestershire & Northamptonshire, dismissed the appeal in full, agreeing that judgment had been properly entered and awarded the Respondent its costs of the appeal. The Appellant has indicated an intention to seek permission to appeal further to the Court of Appeal.

Fintan Molloy is a specialist employment and discrimination barrister who represents both claimants and respondents. Fintan's busy practice covers a wide variety of employment claims, including unfair dismissal, contractual claims, discrimination and whistleblowing cases. Before coming to the Bar, Fintan worked as a litigation consultant for a multinational HR and employment law consultancy firm where he represented respondent clients in the Employment Tribunal. He also gained extensive drafting experience, including opinions, grounds of resistance, skeleton arguments, lists of issues, and witness statements. Passionate about providing pro bono work when able, Fintan was named on Lady Chief Justice Carr鈥檚 Pro Bono Recognition List in 2026. Febienne Green is a specialist personal injury, clinical negligence and inquest barrister. With a strong foundation gained from her pupillage at a specialist personal injury firm and experience as a clinical negligence paralegal in birth injury cases, Febienne has established a thriving practice in trial, appeal, and costs work, whilst also undertaking all manner of interlocutory hearings for both Claimants and Defendants. After substantive advice, Nate's client entered pleas of guilty to serious allegations of violence, which mitigated his exposure to questions on his credibility and meant the cross-examination of the complainant would be both succinct and effective.

Through cross-examination, Nate effectively challenged the reliability of the complainant鈥檚 evidence, exposing inconsistencies with the earlier video-recorded interview.

Nate was then able to persuade the court that there was no case to answer on the two counts of rape (one being a multiple incident count, alleging 10+ incidents) because of the insufficient and tenuous evidence offered by the prosecution.

Nate relied on the second limb of Galbraith [1981] 2 All ER 1060 and the often-cited criminal case of Shippey [1988] Crim LR 767 in his submissions.

The judge directed that the jury return not guilty verdicts to the charges of rape and ordered that Nate's client be released from custody.聽Nate's client awaits to be sentenced on his guilty pleas to allegations of violence.

The case, which revolves around whether a court has jurisdiction to set aside a valid adoption order other than by way of appeal, featured 海角破解版 family barristers Dorian Day and Samantha Smith for the applicant, led by and instructed by ; and 海角破解版 family barrister Kara Cann for the respondent X, being led by and instructed by . The case involved the application to revoke an adoption order for two children, X and Y, invoking the High Court鈥檚 inherent jurisdiction. The application was made by their adoptive mother, AM, and supported at first instance by both children and their birth mother, BM. The children were placed for adoption with AM in August 2012, and the case involved complex dynamics between the children and their birth family.

The Supreme Court's decision was to dismiss the appeal, confirming that there is no inherent first instance jurisdiction to revoke a valid adoption order on welfare or any other grounds. The court ruled that adoption is a complete and permanent status change governed entirely by statute, and any power to permit revocation would require legislative intervention.

Laura Deuxberry wins Court of Appeal case on sex trafficking /laura-deuxberry-wins-court-of-appeal-case-on-sex-trafficking/ Wed, 22 Apr 2026 07:41:00 +0000 /?p=40626 Laura Deuxberry, 海角破解版's criminal, regulatory and public law barrister, was instructed by the CPS Special Crime Division in London, led by Kevin Dent KC, in the recent case of How and Yang [2026] EWCA Crim 476.

Appearing in the Court of Appeal, the appellants聽argued聽that the original trial judge, HHJ Ashworth,聽should have allowed their submission of no case to answer on the trafficking charge.

The Court of Appeal heard the聽appeal聽of the two appellants, one of whom had been earlier sentenced to imprisonment in his absence, in a case which revolved on the point of construction and meaning of Section 2 of the Modern Slavery Act (MSA) 2015.

The appellants' counsel聽argued that聽in order to聽prove an offence under section 2 of the MSA 2015,聽the prosecution had to prove that the accused had trafficked a sex worker in the sense described in Article 4 of ECAT, which included the 鈥榤eans鈥 by which the sex worker was trafficked. The Prosecution accepted at the trial that聽was no direct evidence聽of聽鈥榤eans鈥櫬燽ut聽had argued that Section 2 of the MSA 2015 was clearly worded and that there was enough evidence for a jury to conclude that the sex workers were being trafficked when the appellants arranged for them to travel for sex work in order to control their prostitution.

The Court of Appeal agreed with Laura Deuxberry and Kevin Dent KC鈥檚 submission that the "plain words of the MSA 2015 and the absence in them of any limiting reference requiring proof that the travel was arranged or facilitated by the particular means identified in Article 4 of ECAT". The Court of Appeal therefore dismissed the appeals and held in favour of the CPS' Special Crime Division.

After a five-week trial at Brighton Crown Court, Mr Clarke was convicted unanimously of 45 counts of historic sexual offending against 14 boys committed whilst he was a teacher at a (now closed) private prep school in Sussex during the late 1970鈥檚 and 1980鈥檚.

Clarke's conviction is a significant case in the ongoing efforts to prosecute those who sexually exploit children and adults, regardless of how long ago the abuse took place. The Crown Prosecution Service has emphasized the importance of seeking justice for all victims, regardless of the time elapsed since the abuse.

Mr Clarke is due to be sentenced on 1 June 2026.

The prosecution鈥檚 case was that vulnerable defendant, then aged 18, had raped a 15-year-old girl at a residential address in November 2021. The defendant had a full-scale IQ of 64 (first percentile), the language skills of a child aged between six and nine, markedly impaired memory and pronounced suggestibility under pressure. The complainant was also a vulnerable witness, and both she and the defendant were assisted throughout by registered intermediaries.

The case turned on defendant's two lengthy police interviews 鈥 said by the Crown to be replete with lies and inconsistencies 鈥 and a short video recorded at the scene, which the prosecution said placed the complainant inside the defendant's home. When the Court raised concerns as to admissibility, Nick drafted written submissions to persuade the Judge to allow the key findings of the defence clinical psychologist about the defendant's cognitive difficulties to go before the jury as agreed facts.

Nick invited the jury, in closing, to view the interviews through the prism of how the defendant's mind worked under pressure 鈥 and, in the alternative, to recognise that even if defendant had lied in interview there remained good reason to doubt the prosecution case.

Following a five-day trial, the jury returned a not guilty verdict.

Writing after the verdict, the defendant鈥檚 mother said afterwards: 鈥淵our preparation was meticulous, your manner was calm under pressure, and your advocacy was outstanding鈥 He has a lot of difficulty, and you never let that become an obstacle.鈥

Nicole Bollard is representing the defendants, instructed by Loney Stewart Holland, in a dispute with The Northern Block Limited. The claimant says the company continued using her typeface work without paying her after their agreement ended in 2022. A 2023 court decision recognised her rights, and in 2024 she brought new claims for unpaid royalties and breach of that agreement. The judge refused summary judgment, and only a small claim (under 拢10,000) remains.

Mark Wilden is representing the defendants, instructed by DAC Beachcroft LLP. This dispute is between Titan Wealth Services Ltd, Titan Asset Management Ltd, and Tavistock Investments Plc. It relates to a 2021 business deal and fund management agreement. Titan claims the others acted unfairly and damaged its funds, while Tavistock says Titan mismanaged the funds and misused confidential information. The Court rejected a challenge to its authority and ordered indemnity costs.

In the months leading up to trial, the Crown did not pursue reasonable lines of enquiry identified by the Defence, including relevant text message evidence. Ultimately, recognising the importance of that material, the Crown applied to adjourn the trial. Ben prepared a detailed Abuse of Process application, relying on R v Siddiqua Akhtar [2016] EWCA Crim 390, submitting that the adjournment should be refused and that, in the absence of this critical evidence, a fair trial was no longer possible, and the case ought to be stayed.

The Defendant, a vulnerable young man with significant learning difficulties, had already endured the equivalent of a substantial custodial sentence through a combination of remand and qualifying curfew. Ben submitted that to permit the proceedings to continue would be fundamentally unfair.

In light of the Defence application, the Crown offered no evidence on all seven counts. Not guilty verdicts were formally entered.

This case highlights the importance of rigorous defence scrutiny of disclosure and unused material, particularly in complex relationship-based allegations.

R (SH) was a judicial review concerning the complex interaction between the overcrowding rules in Part X of the Housing Act 1985, the licencing regime for houses in multiple occupation (鈥楬MOs鈥) in Part II of the Housing Act 2004 and the Home Office鈥檚 accommodation of destitute asylum-seeking families in hotels under s.95 of the Immigration and Asylum Act 1999. The case potentially affects the position of approximately 4,300 families.

In the first reported case on the issue, the High Court partly upheld the Claimants鈥 claims for judicial review, gave guidance on the correct approach to assessing the adequacy of accommodation under s.95 of the IAA 1999 and considered the application and relevance of the rules on statutory overcrowding. Jim was led by Kath and represented the respondents in this Special Educational Needs (SEN) case before the Court of Appeal (CoA).

This case concerned two main issues consisting of whether the child needed residential provision and the extent to which section 9 of the Education Act 1996 imposed a positive duty upon it to investigate the cost effectiveness of the provision it ordered.

The Court of Appeal heard the arguments and ultimately agreed with the Respondents that this claim was academic. There was not an active dispute between the parties upon which to rule. Nor did the wider public interest justify the Court exercising its discretion to determine the matter. The appeal was therefore dismissed.

The inquest followed his murder at the hands of his ex-partner in August 2021. She pleaded guilty to Mohammed's murder and was sentenced to life with a minimum term of 22 and a half years in May 2022.

The inquest explored the role played by multi-agencies in safeguarding and risk-assessing Mohammad from his ex-partner, who was known to be a perpetrator of domestic abuse against him.

The Coroner concluded that this was a complex case and a challenging situation for the various state agencies. 鈥婭n essence, he accepted that there were mistakes made by GMP, GMMH, Probation Service and MCC (IDVA) and the system of safeguarding Mr Mukhtar ceased to function, but that none of these shortcomings contributed to Mohammed鈥檚 death. Mohammed was murdered by his ex-partner on 30 August 2021 from ligature strangulation and blunt force instruments in a cruel and callous act. The conclusion given at the inquest into his death was one of unlawful killing.

Nathalie Bull acts in reported case on the recognition of unregistered religious marriages /nathalie-bull-acts-in-reported-case-on-the-recognition-of-unregistered-religious-marriages/ Tue, 17 Mar 2026 14:00:26 +0000 /?p=40117 In MA v WK [2025] EWFC 499, the Family Court (Cusworth J) considered whether Nikkah ceremonies conducted in England but not compliant with the statutory formalities of the Marriage Act 1949 could become valid marriages through subsequent registration in Pakistan. The applications were brought under s.55(1) of the Family Law Act 1986 seeking declarations as to marital status.

Background

Three applicants had each participated in聽Islamic Nikkah ceremonies in England聽that did not comply with the formal requirements of the Marriage Act 1949 and were therefore accepted to be聽鈥渘on-qualifying ceremonies.鈥

  • In two cases, the applicants produced evidence that the marriages had later been聽registered in Pakistan聽(one apparently shortly after the ceremony; another decades later).
  • In the third case,聽no evidence of registration聽abroad was provided.

The applicants argued that聽registration in Pakistan created a valid Pakistani marriage, capable of recognition in England and Wales as a valid foreign marriage.

The聽Attorney General intervened, opposing that position.

Issue

Whether a聽non-qualifying religious ceremony conducted in England聽can become a聽valid marriage recognisable in English law聽by virtue of聽subsequent foreign registration.

Decision

Cusworth J聽refused the declarations聽sought. The court held that聽registration abroad cannot transform a non-qualifying ceremony in England into a valid marriage.

Key Reasoning

  1. Lex loci celebrationis governs formal validity
    The validity of a marriage is determined by聽the law of the place where the marriage is celebrated. Since the ceremonies took place in England, they had to comply with the聽Marriage Act 1949.
  2. Non-qualifying ceremonies cannot be retrospectively validated
    Because the ceremonies did not comply with statutory requirements, they were聽non-qualifying ceremonies聽rather than void marriages. Foreign registration cannot convert them into legally recognised marriages.
  3. Registration does not determine the place of celebration
    The applicants鈥 argument that聽registration should determine the relevant lex loci聽was rejected. The court held that聽the location of the ceremony鈥攏ot later administrative registration鈥攄etermines validity.
  4. Recognition of a 鈥渞ecognition鈥 is impermissible
    Even if Pakistan recognised the marriages, English courts could not recognise聽a foreign recognition of something that English law treats as a non-marriage.
  5. Presumption of marriage unavailable
    The doctrine of presumption of marriage could not apply because there was聽positive evidence that the statutory formalities had not been complied with, which displaces the presumption.

Practical Significance

The decision reinforces the Court of Appeal鈥檚 approach in聽Akhter v Khan聽that聽religious ceremonies in England which do not comply with statutory formalities remain 鈥渘on-qualifying ceremonies.鈥

It confirms that:

  • Foreign registration cannot retrospectively validate such ceremonies, and
  • Parties who wish their marriage to be recognised in England and Wales聽must comply with the Marriage Act 1949 at the time of the ceremony.

The judgment is likely to be of continuing relevance in聽cases involving unregistered religious marriages and cross-border attempts to secure recognition through foreign registration.

She discusses the scope of the duty imposed on data controllers to protect personal data in their possession and control by taking appropriate technical and organisational measures ('ATOMs') and how the security duty is particularly relevant when data controllers fall victim to cybersecurity attacks that result in hackers exfiltrating personal data.

Mariya explains the Court of Appeal鈥檚 judgment, which held that the security duty requires a data controller to take ATOMs against the risk of processing by a third party of data which relates to an individual who is identifiable to the controller, even if the personal data does not enable the third party to identify the data subject in question.
