Paul Froud appears in Court of Appeal case reasserting the need to achieve fairness for vulnerable individuals /paul-froud-in-court-of-appeal-case-reasserting-the-need-to-achieve-fairness-for-vulnerable-individuals/ Thu, 10 Apr 2025 09:51:06 +0000 /?p=34664 The Court of Appeal has today handed down judgment in M (A Child: Intermediaries) [2025] EWCA Civ 440, granting an appeal brought by a Mother against the refusal of the trial Judge to permit her to be assisted by an intermediary during a Fact-Finding Hearing to determine how her (then) 10-month-old son sustained a serious fracture to his skull.

Lord Justice Peter Jackson considered the decisions of Lieven J in West Northamptonshire Council v KA (Intermediaries) [2024] EWHC 79 and Williams J Re X and Y (Intermediary: Practice and Procedure) [2024] EWHC 906 (Fam), as well as the guidance issued by the President of the Family Division (Practice Guidance: The Use of Intermediaries, Lay Advocates and Cognitive Assessments in the Family Court) and concluded that there is no need for any additional test to be applied when considering the appointment of an intermediary, that as a matter of law the solution lies in the effective application of the necessity test found in the FPR, a test that the court has routinely applied to the appointment of expert [搂51]

This important decision refocuses the analysis as to whether an intermediary should be appointed in Family proceedings on the factors contained in FPR 3A.1 & 3A.4 and PD3AA, reversing what has been seen by many as a desire to significantly reduce the number of intermediaries appointed to assist vulnerable parties in family proceedings. The Court of Appeal reminds all who practice in this complex area that 鈥淲hatever may have been the situation in the past, it is now understood that the court must, so far as practicable, adapt its procedures to achieve fairness for vulnerable individuals, in particular by ensuring that all participants are on an equal footing in the light of the importance and complexity of the issues.鈥

The donations are the proceeds of the group鈥檚 Private Law and Financial Remedies Family Law Conference 2024 which took place in May at Birmingham Repertory Theatre. Matthew writes about the Upper Tribunal's decision in this case, and the important points the judgment raises in relation to the conduct of proceedings before the SEND Tribunal when impaired litigation capacity is being considered. UTJ Stout grappled with two interesting issues:

  1. The approach that the First-tier Tribunal should take to recognising and dealing with appeals where an issue of litigation capacity arises, including where concerns arise as to whether the alternative person is acting in the incapacitated individual鈥檚 best interests;
  2. The nature of the recommendations' jurisdiction under the Special Educational Needs and Disability (First tier Tribunal Recommendations Power) Regulations 2017 and its relationship to the underlying health and social care frameworks, including whether and to what extent it is necessary or permissible for the FtT to have regard to, or await completion of, a social care assessment by a local authority before making recommendations.

In this article, published behind a paywall for LexisNexis account holders, Alex Whatley analyses the unsuccessful appeal by the defendant travel company. The parties' primary dispute turned on when the contract was concluded and therefore which terms were incorporated. The Court of Appeal found that the claimants were correct on the date of formation and incorporation remitting the case to the County Court for quantum assessment.

Ben writes about the High Court鈥檚 decision in this case, and its finding that key parts of the Police, Crime, Sentencing Courts Act 2022 amendments to Part V of the Criminal Justice and Public Order Act 1994, were unlawful. The amendments strengthened powers available in response to concerns about anti-social conduct perceived to be associated with 鈥榰nauthorised encampments鈥. The Court鈥檚 judgment finds that the criminal law restrictions on persons who return to unauthorised encampments were a disproportionate and unjustified interference with the ECHR article 14 rights of Gypsies, Roma and Travellers.

The High Court鈥檚 decision means that Parliament now needs to amend the legislation so it is compatible with the UK鈥檚 human rights obligations.

Ms Basilotta had previously been unsuccessful at trial in a claim for sums allegedly owed as part of a contractual arrangement between her and the Defendants. Ms Basilotta brought a second claim in the Intellectual Property Enterprise Court (IPEC) for alleged infringement of copyright in several hundred designs claimed to be worth approximately 拢430,000. Her claim was that the designs had been stored by the company in a medium by electronic means without her permission in breach of sections 16(1)(a) and 17(1)-(3) of the Copyright, Designs and Patents Act 1988.

Nicole Bollard acted for the Defendants at a case management conference before HHJ Hacon, who ordered that Ms Basilotta had failed to adequately particularise her claim and gave her a 鈥渇inal opportunity鈥 to set out the nature of her claim with sufficient clarity. Mark Wilden acted for the Defendants in this resumed case management conference before Douglas Campbell KC, who struck out the claim as insufficiently particularised and 鈥渘ot worth the candle鈥, disclosing at best a technical infringement which could not support the relief claimed.

The case concerned the grooming/abuse of a minor by a work experience student. It provided the Court of Appeal with an opportunity to clarify the 鈥渞elationship akin to employment鈥 and the 鈥渟ufficiently close connection鈥 tests set out in The Catholic Child Welfare Society and others (Appellants) v Various Claimants (FC) and The Institute of the Brothers of the Christian Schools and others (Respondents) [2012] UKSC 56, when deciding if the secondary school defendant was vicariously liable for the tortious acts of its work experience student.

The Court of Appeal went on to clarify that work experience can be a relationship akin to employment for the purpose of vicarious liability. The Court confirmed the difficulty to satisfy the 鈥渃lose connection鈥 test, which requires for the tort and the employment of the tortfeasor to be 鈥渋nextricably woven鈥.

Two of the docker鈥檚 co-conspirators were previously jailed for 14 and 13 years respectively, having admitted their guilt.

  • What is the correct procedure for joinder?

  • How best to run a joinder case.

Stephen Wyeth successful in the EAT in employment status case /stephen-wyeth-successful-in-employment-status-case/ Mon, 03 Jul 2023 14:29:55 +0000 /?p=25522 Employment law barrister Stephen Wyeth has successfully represented United Taxis in United Taxis Ltd v (1) Mr R Comolly (2) Mr R Tidman - and - Mr R Tidman v (1) United Taxis Ltd v (2) Mr R Comolly [2023] EAT 93, a case in which the EAT overturned the ET's decision that a taxi driver, Mr Comolly was both a worker of the taxi operator, United Taxis Ltd (Stephen鈥檚 client) and an employee of the shareholder.

Following a careful analysis of the facts presented to the EAT, HHJ Auerbach ruled against the initial finding of dual employment, establishing instead that Mr Comolly's relationship to the shareholder was that of a "worker".

'Out of Office' band wins Bristol Law Society鈥檚 'Battle of the Bands' /out-of-office-band-wins-battle-of-the-bands/ Mon, 03 Jul 2023 08:27:58 +0000 /?p=25513 海角破解版 Barristers very own house band 鈥淥ut of Office鈥 has won the Bristol Law Society鈥檚 Battle of the Bands contest at The Fleece on Thursday 29 June.

Performing in a packed venue in central Bristol, the band delighted the crowd with songs from Tina Turner, the Killers, the Kings of Leon, the Doobie Brothers, Blur and Green Day.

Nicola Frost (singer) was outstanding in her emulation of Tina Turner, well complemented by James Davison鈥檚 charisma and skills (singer and lead guitarist). Colin McDevitt was superb on bass guitar and Richard Wheeler showed his mastery of the keyboards, the guitar and the harmonica. Francisca da Costa also performs with the band.

The band overcame some fierce competition on the night from Osborne Clarke鈥檚 鈥淥CDC鈥, Thrings鈥 鈥淪tranger Thrings鈥, VWV鈥檚 鈥淭he Narrow Keys鈥 and The Mighty Rufus. 鈥淥ut of Office鈥 were declared winners by the two professional judges and thanks to the audience鈥檚 loud cheers.
